John L. Austin believed that in the illocution he had discovered a fundamental element of our speech, the understanding of which would disclose the significance of all kinds of linguistic action: not only proposing marriage and finding guilt, but also stating, reporting, conjecturing, and all the rest of the things men can do linguistically. 2 We claim that the illocution, the full-fledged speech-act, is central to religious utterances as well, and that it provides a perspicuity in understanding them not elsewhere (...) provided in the work of recent philosophy of religion. In particular we hold that understanding religious talk through the illocution shows the way in which the representative and affective elements are connected to one another and to the utterance as a whole. This study used experimental and correlational techniques to examine perceptions that university faculty hold regarding the practice of professorial selling of examination textbooks to wholesalers. Faculty members (n = 236) from 14 universities and community colleges and a wide variety of academic disciplines responded to a web-based survey. We presented hypothetical selling situations to respondents with manipulated variables consisting of solicitation status (unsolicited versus solicited) and use of money (for faculty or for student activities). Both main effects and the interaction (...) effect were significant such that respondents perceived it to be more ethical to sell an examination book when the book was unsolicited and when the money was being used to fund student activities. The variable most correlated with faculty members' beliefs that book selling is ethical and the faculty members' self-reports of whether or not they have engaged in bookselling was how widespread the practice appeared to be on campus. About 30 percent of faculty members sold textbooks over the past year at a dollar value of about $80 per professor. About 38 percent of respondents reported they believed the practice to be generally ethical. Implications for business ethics theory, students' moral development, and advancement of on-campus codes of ethics policies are discussed along with avenues for future research. (shrink)

The doctrine of the resurrection says that God will resurrect the body that lived and died on earth—that the post-mortem body will be numerically identical to the pre-mortem body. After exegetically supporting this claim, and defending it from a recent objection, we ask: supposing that the doctrine of the resurrection is true, what are the implications for the mind-body relation? Why would God resurrect the body that lived and died on earth? We compare three accounts of the mind-body relation that (...) have been applied to the doctrine of the resurrection: substance dualism, constitutionalism, and animalism. We argue that animalism offers a superior explanation for the necessity of the resurrection: since human persons just are their bodies, life after death requires resurrection of one’s body. We conclude that those endorsing the doctrine of the resurrection should be animalists. (shrink)

Taking on tough constitutional issues implicating gun control, misinformation, and homelessness, the Court also avoided substantive reviews in favor of procedural dismissals in key cases involving reproductive rights and government censorship.

My argument proceeds in two stages. In §I, I sum up the intuitions of a popular argument for 'satisfaction accounts' of Purgatory that I label, TAP. I then offer an argument, taken from a few standard orthodox Christian beliefs and one axiom of Christian theology, to so show that TAP is unsound. In the same section, I entertain some plausible responses to my argument that are prima facie consistent with these beliefs and axiom. I find these responses wanting. In §II, (...) I offer a sorites problem for TAP, given the orthodox Christian understanding of Christ’s parousia, showing that TAP and the intuitions driving it are faulty. To attempt something of a corrective, I end by offering some modest theological suggestions for thinking through “the logic of total transformation.”. (shrink)

There are two competing approaches to sustainability in agriculture. One stresses a strict economic approach in which market forces should guide the activities of agricultural producers. The other advocates the need to balance economic with environmental and social objectives, even to the point of reducing profitability. The writings of the eighteenth century moral philosopher Adam Smith could bridge the debate. Smith certainly promoted profit-seeking, private property, and free market exchange consistent with the strict economic perspective. However, his writings are also (...) consistent with many aspects of sustainable agriculture. For example, Smith argued that people ought to exercise restraint in their pursuit of self-interest, and he believed in balancing economic with environmental and social considerations. If both sides of the debate more fully regard the work of Adam Smith, then proponents of the strict economic perspective might be more appreciative of the concerns raised within the sustainable agriculture community, while advocates of sustainability might be more effective in achieving the objective of a sustainable agriculture. "Embracing the One" (baoyi 抱—) and "holding to the One" (zhiyi 孰—) are phrases that appear in different versions of the Daodejing. This essay argues that, in a specific philosophical context, these two phrases represent competing philosophical attitudes that stem from opposing cosmological visions. The recently unearthed "Great One Produces the Waters" (Taiyishengshui ) assists in the reconstruction of this philosophical context, as does a re-reading of the "One" in the famous generative sequence of chapter 42 of the Daodejing. Ultimately, (...) it is argued, the phrase "embracing the One" represents an attitude that is quintessential "Daoist" in nature, while "holding to the One" signifies the adoption of the Daodejing by competing philosophical interests. In this paper, I offer something of a prolegomenon, outlining some areas in which certain strands of biblical theology and analytic theological reflection can be mutually informative. To do so, my paper unfolds in three ways. In the first section, I provide some reasons to think that biblical theologians are onto a reading of Scripture that merits the attention of analytic theologians. In section II, I outline some areas in the biblical theological data that would benefit from analytic exploration and (...) reflection. Finally, in sections III and IV, I present a test case: the imago Dei and the importance of the future bodily resurrection. It is largely taken from my law review article entitled "'We Shall Not Be Moved': Eminent Domain, Urban Redevelopment and the Socioeconomics of Just Compensation" published by St. John's Law Review. That article can be downloaded from SSRN at http://papers.ssrn.com/sol3/papers.cfm?abstract_id=904224 This shorter piece focuses on the two proposals outlined in the second part of the law review article that (...) are designed to curb abuses of eminent domain in the urban redevelopment context without destroying its effectiveness as a tool for community revitalization and, even, community empowerment. Specifically, homeowners should not be subject to eminent domain pursuant to a redevelopment plan until the majority of them have approved the plan. To further solidify resident ownership of redevelopment, the right to continued residency in the community should be protected by amending relocation laws to guarantee an alienable entitlement to be offered replacement housing in the redeveloped district area. Together, these two legislative reforms express a more nuanced balance of property and liability rules that will facilitate a more productive interface between community residents and redevelopment officials. In working his way through his complex conception of the relation of fiction and reality, [Henry] James thus found the unconscious moral dimension inextricably embedded within "realism" itself. In following the threads of realism back to consciousness itself, James invariably found there intertwined with its roots those aspects and elements that other theorists kept carefully separate. By exploring experience to its source, he found imagination. By following objective life from "out there" to conception, he found individual vision. By (...) following the seeming oneness of the passing show back to perception, he found infinite variation and multiplicity. By following the uncolored flux and flow of events to their embodiment in the fictional medium, he found coloration of personality. And by following the "felt life" back to the artist's "prime sensibility", James found there the "moral sense" and the "enveloping air of the artist's humanity"—that which gives "the last touch to the worth of a work." On first blush the Jim Crow Era may seem an odd place to locate anything meaningful about democratic, equal citizenship and the promise of the fourteenth amendment. This article argues to the contrary. The period of Jim Crow, in its negation of democratic citizenship, in fact reveals import aspects about the nature of democratic citizenship. This occurred in two ways. First, whites who implemented white supremacy implicitly understood that freedom and citizenship manifest themselves in a multiplicity of spheres, which is (...) why white supremacists sought to subordinate blacks not just politically but across all social spheres. Second, the resistance to comprehensive subordination revealed the multiplicity of the spirit of freedom and equality in actions and arguments African Americans. African Americans created spaces of democratic citizenship within the dominant culture of subordination. This article suggests that, in studying both the implementation of white supremacy and the resistance to it, we can learn more about how equal and democratic citizenship can be affirmed and implemented rather than negated, and also about the role of law as a tool for both subordination and resistance. To analyze the concept of a human merely in terms of the concept of a primate is to let all kinds of monkeys and apes into a category reserved for humans. Criteria of identity for universal attributes formulated merely in terms of causal roles associated with universals involve a similar permeability, since they cannot distinguish universals from non‐universal attributes. Without appealing to the existence of noncausal universals or resorting to charges of circularity, I will show that causal criteria of identity (...) for universals are insufficiently informative because they cannot capture a distinctive feature of universals. The Metaphysical Club, a gathering of intellectuals in the 1870s associated with Harvard, is widely recognized as the crucible where pragmatism, America's distinctively original philosophy, was refined and proclaimed. Louis Menand's bestseller about the group was a dramatic publishing success. However, only three actual members - Oliver Wendell Holmes Jr., Charles S. Peirce, and William James - appear in this book, alongside other thinkers such as John Dewey who were never in the Club. The Real Metaphysical Club tells the (...) full story of how this influential group shifted the course of philosophy in America. In addition to pioneering pragmatism, the group explored radical empiricism and idealism, and formulated personalism and process philosophy, equally important developments. This volume contains thirty-seven important writings dating from 1870 to 1885 by the real members of the Metaphysical Club. The first section centers on pragmatism and science; the second part collects writings of the lawyers; and the third part covers idealist and personalist philosophers. Many of these writings have never been reprinted before, and nothing like this impressive collection has ever been attempted. A general introduction provides a narrative history, and the editors' three introductions to the volume's sections vividly bring to life the intense meetings, sustained debates, and pioneering thought from the Metaphysical Club. Fundamental theological and ethical themes of Luther's thought and tradition provide a basis for appreciating both the role of business in God's providential design and the importance of occupation for living out one's Christian vocation. These same insights establish the ethical basis for a critical appraisal of the current practice of downsizing and its negative impact on the quality of individual lives and whole communities. In a recent paper titled “Mencius and an Ethics of the New Century,” Donald J. Munro argues that recent theories in the evolutionary sciences regarding the biological basis of altruism and infant bonding might lend credence to Mencius’ philosophy of human nature.1 Such theories, says Munro, support Mencius’ contention that certain moral concepts derive from something that is inborn. What such naturalistic theories do not address, however, is whether or not these moral concepts are also “founded on something transcendental,” and (...) by this Munro is referring to the suggestion that “human nature” (renxing 人性) is derived from “Heaven” (tian 天).2 Munro suggests that contemporary philosophers who draw inspiration from .. The symposium »Does the Concept of ›Truth‹ Have Value in the Pursuit of Cross-Cultural Philosophy?« hones on a methodological question which has deep implications on doing philosophy cross-culturally. Drawing on early Confucian writers, the anchor, Henry Rosemont, Jr., attempts to explain why he is skeptical of pat, affirmative answers to this question. His co-symposiasts James Maffie, John Maraldo, and Sonam Thakchoe follow his trail in working out multi-faceted views on truth from Mexican, Japanese Confucian, and Tibetan Buddhist perspectives respectively. (...) As these positions substantiate, the aforementioned non-Anglo-European traditions seem to draw on an integrated view of thinking, feeling, and living a human life. In a new era of regulatory oversight, the US Supreme Court upended traditional Chevron deference to agency interpretations of ambiguous Congressional provisions in Loper in June 2024. Federal courts were instructed to make their own assessments of statutory authorities amid an onslaught of public health agency challenges surfacing nationally. Even so, SCOTUS may be eyeing further limits on agency powers despite clear and substantial repercussions for the health of the nation.

As the title suggests, this is a volume of eighteen recent essays on Descartes, Spinoza, and Leibniz. The idea for this compilation arose out of Jonathan Bennett’s 1995 National Endowment for the Humanities Seminar on Descartes, Spinoza, and Leibniz. The authors, many of whom were involved in that seminar, worked together to create this kind of loose dialogue. While each essay stands by itself, several of the works in the volume show evidence of the influence of the other authors. As (...) the editors note, “Each author commented on at least two other chapters before the final works were submitted”, and it shows. Furthermore, the volume is consistently edited, with a coherent style, and includes provocative and scholarly essays. (shrink)

The correspondence between G. W. Leibniz and Samuel Clarke on the implications of Sir Isaac Newton’s physics to natural theology was the last battle that Leibniz fought with the Newtonians. That battle, not so famous as the one over the invention of calculus, ended abruptly with the death of Leibniz in November 1716; however, Clarke soon after translated the correspondence into English and published it in 1717. It became one of a relatively tiny number of Leibniz’s writings to be published (...) before the nineteenth century. Thus, besides being a meaningful clash of the rationalist and empiricist traditions, the correspondence between Leibniz and Clarke was one of the few primary sources that eighteenth-century philosophers had of the mature thought of one of Europe’s most celebrated thinkers. Furthermore, it was relevant to the philosophy of that day. Immanuel Kant, for instance, used the correspondence to launch his own formulation of space and considered his theory a resolution of the controversy. (shrink)

In this excellent book, George A. Panichas, longtime editor of the conservative quarterly Modern Age, brings to a conclusion a critical trilogy, really a tetralogy, which includes The Reverent Discipline, The Courage of Judgment, and The Critic as Conservator. The unusual title is inspired by Plato’s Phaedrus, with Panichas writing at one point—concerning literary scholar Austin Warren’s “open celebration of great ideas, great writers, great souls”—that, “Literary greatness for him meant spiritual greatness, this is, the kind of greatness that gives (...) us guidance and helps to orient us towards the good, or, as Plato puts it, to make us ‘grow wings to overcome gravity’”. Ontology is one strategy for promoting interoperability of heterogeneous data through consistent tagging. An ontology is a controlled structured vocabulary consisting of general terms (such as “cell” or “image” or “tissue” or “microscope”) that form the basis for such tagging. These terms are designed to represent the types of entities in the domain of reality that the ontology has been devised to capture; the terms are provided with logical defi nitions thereby also supporting reasoning over the tagged data. Aim: This (...) paper provides a survey of the biomedical imaging ontologies that have been developed thus far. It outlines the challenges, particularly faced by ontologies in the fields of histopathological imaging and image analysis, and suggests a strategy for addressing these challenges in the example domain of quantitative histopathology imaging. The ultimate goal is to support the multiscale understanding of disease that comes from using interoperable ontologies to integrate imaging data with clinical and genomics data. (shrink)
